Types of Damages for Personal Injury
Collecting Damages for Your Injury
You can seek a few types of compensation: compensatory damages, punitive damages and nominal damages.
Some factors determine the amount of damages that are awarded, including the nature of the injury, the extent to which the person was injured and the duration that the person suffered from the injury.
Here is a rundown of the different types of damages you might see as a result of an auto accident, a dog bite, slip and fall or any other personal injury as the result of someone's negligence:
Compensatory Damages
Compensatory damages are meant to reimburse you for your injury. The two types of compensatory damages are actual damages and general damages.
General damages reimburse you for things you have not paid money for, yet still experience a loss. This includes future lost wages, harm to your marriage, emotional suffering, and disfigurement, among other things.
Nominal Damages
If little evidence of actual damages exists, the courts still may choose to award you a small sum of money to acknowledge that the defendant legally wronged you.
Punitive Damages
Courts may order the defendant to pay the plaintiff punitive damages, which are meant to punish the defendant for his or her actions, if he or she is found to have acted intentionally, recklessly, or maliciously.
