You Pay Nothing Unless We Win Your Case!
Medical device manufacturer Philips Respironics announced on June 14, 2021, a recall of many of its sleep apnea CPAP machines and BI-PAP ventilators for respiratory failure. The recall affects nearly 3.5 million individual units, which all include a common risk. Allegedly the machines’ sound dampening material can break down and get released directly into the air pathways of users, exposing them to toxic chemicals.
Users of the affected Philips machines nationwide are filing lawsuits against the company. Metzger Wickersham is prepared to accept claims from those who need to pursue compensation for medical bills, lost wages, and other damages associated with the use of a Philips CPAP machine or BI-PAP ventilator. If you or someone you love became ill or injured after using one of these machines, you may be entitled to recover compensation.
Please note: When in the best interest of the client, Philips CPAP Machine lawsuits may be referred to other law firms.

What Is the Reported Problem with Philips Respironics Products?
The reported problem with the products recalled by Philips Respironics concerns the polyurethane (PE-PUR) foam used to reduce the sound that the machines produce.
The company has revealed that this foam can break down and be ingested or inhaled by a patient using a CPAP or BI-PAP machine. The foam may emit volatile organic compounds, which can adversely affect organs or even cause cancer.
Exposure to foam particles may cause the following:
- Headaches
- Irritation
- Inflammation
- Respiratory issues
- Cancer
Chemical exposure due to off-gassing from foam particles may cause:
- Headaches
- Irritation
- Hypersensitivity
- Nausea and vomiting
- Cancer
What Are the Allegations against Philips Respironics?
The primary lawsuit against Philips Respironics alleges that the company failed to warn consumers about the potentially serious health effects of using the devices named in the recall. It also states that the company had information about the devices’ potential to cause harm but did not make consumers aware of the potential adverse effects.
Which Devices Are Included in the Recall?
Philips Respironics has included the following devices in its CPAP Machine recall:
- SystemOne
- C-Series
- OmniLab Advanced Plus
